Attached, you will find Florida Legal Precedents Defining Correctional Officers as Law Enforcement Officers and First Responders.
Honestly, there is no legal argument needed here as there are more than 40 years of Florida legal precedents on the books making this a prima facie case.
Ironically, what is severely needed in our situation is for someone to "Enforce the Law" on a statewide basis.
We propose the following amendment to Fla. Stat. § 112.1815: (1) The term “first responder” as used in this section means a law enforcement officer or correctional officer as those terms are defined in s. 943.10(1) and (2), a firefighter as defined in s. 633.102, or an emergency medical technician or paramedic as defined in s. 401.23 employed by state or local government.
In addition, we propose a new definition be added to Fla. Stat. § 943.10 (23) The term "law enforcement member" means a law enforcement officer, correctional officer, Sheriff's Deputy, Sheriff's Detention Deputy, and a Correctional Probation Officer.
Thank you for all you do and May God Bless You.
AS BOTH MEMBERS OF LAW ENFORCEMENT AND AS FIRST RESPONDERS
